Welcome to D-IFill ATV Rentals & Tours! By engaging in our ATV tour activities, you agree to the following terms and conditions. It is crucial that you read and understand each section to ensure a safe and enjoyable experience. Your participation implies acceptance of these terms.

I. Acknowledgment of Risks

By participating in ATV tour activities with D-IFill ATV Rentals & Tours, I acknowledge and understand that these activities involve inherent risks. These risks include, but are not limited to, rough terrain, unpredictable weather, wildlife encounters, vehicle collisions, and mechanical failure. Participation in these activities may result in injury, accident, or property damage. I freely and voluntarily assume all risks associated with the activity, whether foreseeable or unforeseeable.

 

II. Waiver of Liability

I hereby waive, release, and discharge D-IFill ATV Rentals & Tours, its employees, agents, and affiliates from any and all claims, liabilities, and damages arising from my participation in ATV tour activities, including but not limited to personal injury, property damage, or wrongful death.

 

III. Safety Agreement

I agree to wear all required safety equipment, including helmets, and follow all safety instructions provided by D-IFill ATV Rentals & Tours staff or tour guides. I will refrain from reckless driving or behavior that may endanger myself or others, and I will abstain from using alcohol, drugs, or any other impairing substances before or during the activity. I understand that failure to adhere to these safety rules may result in the termination of my participation without refund.

 

IV. Assumption of Risk

I understand and accept the risks associated with ATV riding and voluntarily choose to participate. I certify that I am physically and mentally fit to engage in these activities.

 

V. Indemnification

I agree to indemnify and hold harmless D-IFill ATV Rentals & Tours, its employees, agents, and affiliates from any and all claims, liabilities, and expenses, including attorney fees, arising from my participation in ATV riding activities.

 

VI. Cancellation Policy

Cancellations must be made at least 48 hours before the scheduled tour or rental. If you cancel within 48 hours of your booking, no refund will be provided. In case of extreme weather conditions or other unforeseen events, D-IFill ATV Rentals & Tours reserves the right to reschedule or cancel tours. In the event of a cancellation initiated by us, a full refund will be offered.

 

VII. Refund Policy

Refunds are only provided for cancellations made more than 48 hours in advance. No refunds will be provided for no-shows or late arrivals that miss their scheduled tour or rental time.

 

VIII. Payment and Booking Policy

A deposit or full payment is required at the time of booking. Payment can be made through our secure online payment system, and your booking will be confirmed via email once payment is received.

 

IX. Photography and Videography Release

By participating in any D-IFill ATV Rentals & Tours activities, I grant permission to use any photographs or videos taken of me during ATV tour activities for promotional purposes. This includes use on the company’s website, social media platforms, and marketing materials.

 

X. Age and Eligibility

All participants must be 18 years or older to rent or operate an ATV. Participants between the ages of 16-18 may operate an ATV with parental consent and supervision.

 

XI. Code of Conduct

Participants are expected to respect the environment and the community during their ATV rides. Littering, destruction of property, or behavior that harms wildlife will not be tolerated. Violations may result in the termination of the activity without refund.
